Parents and Grandparents! This is a Must Read about Your Rights! Posted 7 months ago

When I was at the FPEA homeschool convention I went to the legal updates on Parental Rights with a very well known attorney speaking on the attacks against your rights as parents and grandparents. This is not just about homeschooling your kids, this is about every single issue that has to do with you being a parent so please read this post and then resolve to take action to protect your rights as parents and grandparents.

Allow me to set the stage first so you will understand the horrific consequences of the elitists who are the only ones who stand to gain from this stripping of rights.

The 'grass roots' people which are us, the majority believe that parents should raise their children as they feel right to do so, that parents have the right to teach religion to their children and that they have the right to choose the education for their children. We, the majority also believe that we should have due process under the law if we are accused of neglect or abuse. Of course none of us want children to be abused and the states should have the right in the best interest of the children to remove them from their homes IF their parents are abusive and neglectful. But having been not just a teenager going through the system to being the one calling the cops on my X husband to my X husband making anonymous calls to the child protective services with allegations that were totally unfounded and untrue after our divorce just because I divorced an abusive man but I was automatically guilty until I proved my innocence! There was no due process so I can testify to the damage that the state can do to families without due process. My mother was still the best thing for me and being taken away from her only led to more problems for me as a teen not less.

Unfortunately 4 of the Supreme Court justices have said said that the constitution does not give parents fundamental rights. The difference between fundamental rights and non fundamental rights is the right to due process. The right to own property in our country is a right in our constitution but it is NOT a fundamental right. So if your property is being taken by eminent domain you must prove why the government should not take away your land. The burden of proof is on you.

In 1868 the Supreme Court ruled that no person's liberty should be denied without due process and that parents are included in persons. There is an elitist Stanford professor who is on a rampage to change this and make sure we do not have due process. The elitists are a very small yet powerful group of people who intend on socialism for our country. They speak loud and have lots of money but they do not speak for the majority of Americans. This Stanford Professor is against homeschooling because 'the children are not being socialized correctly'. What he means to say is, 'the children are not being socialismized correctly to his way of thinking.' In other words they are not getting brainwashed with his agenda.

This means that you as a parent does not have to be notified that your 1st grader is going to a sex education class at school. That once you drop off your child at school you have NO say in what he/she is going to be taught. You will no longer have the right to be informed. This has already happened in Massachusetts. I think I should have the right to decide at what age my child is to learn about this subject. If this has not visited your state yet, don't be relaxed, it is coming to your state too!

So the only answer is to amend the constitution to specifically state that parents do have fundamental rights. That is where ParentalRights.org comes in. We joined ParentalRights.org last weekend for a contribution of $25. for the year. Of course I will be raising a lot more money for this cause.

Now, let me explain what the real threat is and where it is coming from. It is an International Treaty that every single country has signed and ratified by the UN. The only countries who have not signed this bill are United States of America and Samolia and the only reason the latter has not signed it is because it does not have a government. But there is huge pressure on the U.S. to sign this treaty. Take note that all the Islamic nations signed it but took reservation. This treaty says:

1) The Child Has The Right Of Self Determination

2) The government will decide what is in the best interest of the child in every single case.

Now let me tell you what the problem with this is. In California a state judge says that homeschool is illegal. Governor Schwartzeneger and the head of California education said that this was not going to happen in California and that they will just pass legislation to make sure that parents have the right to homeschool their kids and to choose their children's education.

But International Treaties trump ALL state constitutions and laws.

Do you understand the threat here? Our founding forefathers put this in the constitution that International Treaties trump state law because they were concerned with piracy and such, not that parents would no longer be able to discipline, teach or train their children without the government's consent!

Here is an excerpt about the International Treaty from ParentalRights.org website:

The only thing that will trump an International Treaty is the United States Constitution.

Based on different state supreme court rulings the ParentalRights.org has come up with the language that we want the constitution to be amended to:

Section 1- The liberty of parents to direct the upbringing and education of their children is a fundamental right.

Section 2- Neither the United States nor any state shall infringe upon this right without demonstrating that its governmental interest as applied to the person is of the highest order and not otherwised served.

Section 3- No treaty nor any source of International law may be employed to supersede, modify, interpret, or apply to the rights guaranteed by this article.

Sections 1 and 2 are directly taken from the United States Supreme court ruling of 1920 even to the point of directly taking their exact language. Section 3 is taken from the Wisconsin Supreme court case where the Amish families were under attack for teaching their children and not complying with compulsary attendance.

ParentalRights.org can not take this to the floor yet. We must gather petitions and signatures from the people. We must call our senators and congressmen to tell them that we want them to support this ammendment. There are a few Republicans that have committed to sign on this ammendment but we need this to become a bipartisan measure or it will fail. This should have nothing to do with bipartisanship. All parents are affected by this treaty no matter what party you are affiliated with.

Let me explain some of the consequences of this type of law in action. Washington State had this law on their books and since this time it has changed. But they had a law just like this international treaty. This is how bad the government behaves when they have power over your children. Please do not look at this as a way to protect the abused children. It is not. There are other ways to protect and take away children who are being abused.

These are cases that this attorney defended against the state of Washington in behalf of the parents.


  1. A 13 year old boy went to his school counselor and complained that his parents were bringing him to church every single Sunday. He did not want to go with them. They made him go with them. The counselor said this was excessive to bring a 13 year old to church on Sundays and had him removed from the home. When the parents went before the judge, the judge said that bringing a child to church every Sunday was way too much. They had this choice; stop bringing their son to church every Sunday or have their son put in foster care!!!!!!



I can't get over this one! The parents did not have the money to fight this judge and they wanted to keep their son so they caved in! This is what 'the will of the child' means in these cases. First, the religion issue is one that I would have been screaming about! State controlling religion! But this 13 year old was not being abused or neglected! I go to Church every single Sunday and so do my kids. There are not in danger for so doing!


  1. A 13 year old girl was caught by her parents having sex with an 18 year old boy and smoking pot. The parents grounded her. She went to school and complained that they were enforcing a harsh punishment of grounding on her. They took her away from her parents. In court, the judge said that the parents could not ground their daughter. They told the judge she was not allowed to smoke pot or have sex and those were their rules. The judge put her in the system. Today that girl is a 30 year old woman who is fighting this International Treaty with all her might because she says all she needed as a 13 year old child was for the judge to tell her to go home and obey her parents! She said his decision to give her permission to be wild and in the foster care system ruined her life for the next 15 years. It took her years to get over all that happened to her in the system.



We need to get people involved. Please go to the ParentalRights.org website and volunteer to start the grass roots support of our parental rights.

Our forefathers fought to stop the British from ruling us and many died to protect our sovereignty. We need to stand up now to protect our American Sovereignty.
